A coalition of health and environmental grassroots groups has launched the 704 No MoreTM initiative, a new legal and legislative effort to restore state and local rights over cell towers and antennas. The federal preemption in Section 704 of the Telecommunications Act of 1996 has prevented state and local governments from limiting antenna infrastructure on health or environmental grounds. This has resulted in many people, including children, becoming acutely ill from nearby cell towers along with many other negative impacts.
Scientific research going back decades also shows many chronic and cumulative effects from long-term exposures to the Electromagnetic Radiation emitted by infrastructure, with much evidence documented decades ago in U.S. government studies (before there even was a cell phone industry[1]). Many of today’s chronic illnesses saw explosive growth beginning in 1990, when the roll-out of antenna infrastructure began.[2]
704 No MoreTM Launches
The 704 No MoreTM Coalition, formally launched recently, believes state and local governments should have the authority to protect communities’ health from Radiofrequency Radiation and prevent harmful environmental and ecosystem effects. The 704 No MoreTM coalition is pursuing a multi-pronged legal, legislative and advocacy agenda to dismantle Section 704, and is seeking both financial and grass-roots advocacy support for the multi-year legal effort.
The 704 No MoreTM team would greatly appreciate the Building Biology community’s help in spreading the word about 704 No MoreTM and in identifying plaintiffs for the litigation.
Beyond reversing the Section 704 preemption, and restoring state and local rights, 704 No MoreTM also aims to restore individual rights. Some Courts have ruled against injured parties seeking legal recourse to which they would otherwise be entitled, citing “conflict preemption.” Injuries from the placement of cellular infrastructure being denied legal recourse include acute and chronic health effects, environmental impacts, negative aesthetic effects, real estate devaluation, temporary housing, relocation costs, farmers’ and ranchers’ crop and livestock impairments and more.

The Legal Work Ahead
Legal strategy for 704 No MoreTM is being led by W. Scott McCollough, Esq., Lead Litigation Counsel to Children’s Health Defense’s EMR & Wireless Program, in collaboration with Constitutional expert, Prof. Jed Rubenfeld of Yale Law School.
McCollough, Esq. says, “Electromagnetic Radiation (EMR) emitted by wireless equipment is responsible for extensive health and environmental injury. Communities must be able to control placement of antenna infrastructure. Those harmed by involuntary radiation exposures must have their rights restored.”
Rubenfeld adds, “We will confront head-on the industry’s claim for immunity from liability, ensuring and restoring individual rights. We will also challenge the whole idea of federal preemption in this area, so that traditional state laws protecting individuals from harm can once again be enforced and so that local control can be reestablished.”
In the search for plaintiffs, the 704 No MoreTM legal team seeks plaintiffs with high credibility and diverse harms who are located in 5 states: Maryland, Virginia, West Virginia, North Carolina, or South Carolina. They might include farmers, ranchers or beekeepers whose crops, livestock or pollinators have been demonstrably harmed resulting in economic loss, loss of property use, yield decline, reproductive failure in livestock, colony collapse disorder in bees, etc. Or, individuals with EMR Syndrome (EMR-S) (electrosensitivity) with a formal diagnosis, robust medical documentation of injuries/disabilities, workplace/home accommodation efforts, and physician declarations. Plaintiffs must be willing to litigate, provide declarations, records and testimony in support of both the factual and Constitutional basis of the case, strengthening the case by sharing their personal lived-experience and the real-world impacts of cellular infrastructure.
704 No MoreTM’s Grassroots Mobilization & Legislative Advocacy Committee is being led by Odette Wilkens, Esq. of The National Call for Safe Technology. In addition to advancing litigation, the initiative will advance legislation and educate the grass roots about 704 No MoreTM objectives. This Committee will keep a close eye on the dozens of bills introduced in Congress seeking to further enable and expand wireless infrastructure, legislation which is unfortunately typically directly counter to 704 No MoreTM objectives.
